Acceptance of Terms of Usage
Domain name www.gamenation.in (hereinafter referred to as “Website”) is owned by GN Interactive Pvt Ltd with its registered office at 3/183, 1st Floor, Velu's Tectum, ECR, Vettuvankeni, Chennai - 600115, Tamil Nadu (hereinafter referred to as “GAMENATION”).
Your use of the Website and its services and tools are governed by the following terms and conditions as applicable to the Website including the applicable policies which are incorporated herein by way of reference. If you transact on the Website, you shall be subject to the policies that are applicable to the Website for such transaction. By mere use of the Website, you shall be contracting with GAMENATION and these terms and conditions including the policies constitute your binding obligations, with GAMENATION.
GAMENATION reserves the right to make changes to this Site and to these Terms of Usage at any time without prior notice. You should review these Terms of Usage each time you access this Site.
You also agree that we may provide all communications (including marketing communication) to you electronically by posting them on our website or, at our election, by sending an e-mail to the e-mail address you provided to us when you registered at our website or by calling on your registered phone number or by sending promotional sms to the mobile number registered on our website. You also agree that we may provide all service implicit communications with regards to your order and account to the registered mobile number and email address.
All the terms and conditions and/or any transactions occurring online at www.gamenation.in are subject to the laws of Chennai, India. GAMENATION is not responsible for the delay and/or damages resulting from Acts of God, Pandemics and from other actions, both governmental and otherwise, including but not limited to war, riot, seizure, and embargo. The Buyer’s order shall be deemed an acceptance of the Seller's terms. The Terms and conditions shall in all respects be governed by jurisdiction of the Courts of Chennai, India. All orders are subject to acceptance by GAMENATION. We reserve the right to reject any order at any time without recourse. We also reserve the right to change the price at any time even after we receive the order.
CANCELLATION / REFUND POLICY
1. Please write to us on [email protected] in case you wish to cancel your buy order or sell order. However, we will not be able to cancel an order if the shipment is already in transit.
2. To return products that are damaged in transit or in case a wrong product is delivered, please contact customer support by email on [email protected] within 24 hours of delivery. A pre-owned game will not be eligible for return towards minor transit box damage. Brand new products will not be eligible for return if the manufacturer packaging has been opened. Any return requests later than 24 hours after delivery will not be entertained with regards to a damaged or wrong product being delivered.
3. All Pre-owned games carry a 7 day return policy covering only against functionality issues. All our Pre-owned discs carry our logo stamp to facilitate easy returns in case of any issue and to avoid fraudulent claims. No returns shall be entertained if the stamp is tampered with. Only the discs containing our logo stamp will be eligible for return/replacement under any circumstances.
4. In the event of return of product due to non functionality, we will schedule a return pickup and the product received will be tested and a replacement will be provided subject to no physical damage on the product and also its satisfying the policy defined in point no.3. No replacement will be provided if the product is in perfectly functional condition and the same will be returned back to the user after the payment of necessary shipping charges.
5. Pre-owned hardware comes with a 1 month warranty (30 days) from our end starting from the date of delivery. In the event of any issue occurring in the product, the same has to be informed to us immediately to process for servicing. If an issue is noticed within 7 days from the date of delivery, the product will be replaced. If an issue is noticed after 7 days and before 30 days, the product will be serviced through our vendors and will be sent back to the user, the user will have to bear with us for the time period taken by the vendor to service and fix the product. Warranty becomes void in case the product has physical damage or repaired or the warranty seal is tampered with.
6. Warranty claims for brand new hardware which come with manufacturers warranty (details if mentioned on the description of the product) will have to be claimed directly with authorized service centers of the manufacturer.
7. A processing fee of 3% including taxes will be charged on cancellation of prepaid orders with payment method as Razorpay payment gateway before dispatch. In case the product cannot be dispatched due to a fault of GAMENATION (Eg. Out of Stock), then this fee would not be charged. In case of the payment method being store credit, the refund would be credited back to store credit only.
8. Any request for cancellation of orders once dispatched shall not be entertained.
9. We provide refund only in case of non availability for the same product for replacement and for following conditions :
- *Damaged or Faulty Product(s).
- *Wrong Product(s) delivered which are not as per your order.
- *Cancellation of order before dispatch.
- *Cancellation of order due to stock unavailability.
10. Please allow up to 7 working days for your refund to be processed.
11. Refund would be processed directly to the original mode of online payment and cannot be refunded to alternative modes of payment.
Disclaimer for Pre-owned games sold by us:
1. The dlc code if any with the game will not be included.
2. The manual booklet may not be included.
3. The art cover may not be same as the one seen on product page as there is a possibility of the developer releasing the game with different designs of art cover over a period of time.
4. The game boxes that contain two discs may have the disc holder clip broken on the inside.
5. The region of the disc may not be Indian, although we guarantee complete gameplay to be available on the disc from the base game.
6. The free digital upgrade for PS5 version through a PS4 disc is not guaranteed.
7. The game box may contain minor damages which does not affect the game in any way.
1. We offer Free Shipping on all orders regardless of Prepaid or COD orders.
2. All shipments will be packed safely and securely to prevent damage in transit.
3. Orders placed before 4:00 PM IST, on a business day will be shipped out the same day, orders placed after would be shipped the following day. We would always try to ship the product as early as possible.
4. We ship our products through reputed Courier partners such as BlueDart, Delhivery, FedEx, Xpressbees which are the best in business and through DTDC or Speed Post for remote locations.
5. Transit time is typically 1-2 business days for Metro cities / state capitals and 3-4 business days for other cities. It may take a little longer for very remote locations.
6. Shipment details and tracking link will be sent to your Email once the product is dispatched and the same will also be updated in My Account.
7. Pre-Order orders will be shipped on the release date of the game and the shipping details would be shared to you by Email on the date of dispatch.
8. We offer a free pickup facility through our courier partners for the games or other products you wish to sell to us. However, some of the pincodes are not serviceable. In that case we offer an option for you to self ship to us through your preferred courier and we'll reimburse you Rs.100 to cover the shipping cost borne by you.
Trade in Policy For Sell Orders
(Regarding Selling Items at www.gamenation.in for Cash/Store Credit)
1. You warrant and represent that you are the sole and rightful owner, or have the authority of the owner to sell the product(s).
2. You agree that all information you provide about the Item for sale as well as information you have or will provide about yourself is true, accurate, and complete.
3. You acknowledge and agree that GAMENATION may reject or limit the quantity of Items to be sold. You agree that all determinations of GAMENATION with respect to sale value (cash or credit) assigned to the Item after its inspection will be accepted as final and is not negotiable.
4. Upon receipt and acceptance of the Item by GAMENATION, you hereby agree to transfer all right to and title in the Item to GAMENATION, in exchange for cash or credit value offered to you.
5. You acknowledge and agree that the sell transaction is final and cannot be cancelled or rescinded by you after your Item is received by GAMENATION, unless GAMENATION contacts you to provide notification that your description of the Item was inconsistent with GAMENATION’s evaluation of your Item.
6. You agree to ship the Item to the address provided so that it arrives within 10 days of accepting the estimate. If the Item is not received within 10 days of the date from which the order was created by you, then GAMENATION has the right to revise or withdraw the estimate for the sale or the outstanding cash or credit value of the Item.
7. GAMENATION will cover your cost in case of self-shipment by offering additional Rs.100 in cash or credit for each shipment received. If products from multiple orders are received in a single shipment, Rs.100 will be not offered for each order and Rs.100 will be offered only once for a shipment received. Alternatively you can opt for our free pick-up service and have a hassle free sale from the comfort of your home (subject to availability).
8. You agree that GAMENATION will not be responsible under any circumstances for any loss or damage to the Item during transit where pickup was not arranged by GAMENATION.
9. You agree that you are providing the Item to GAMENATION in working order, and you shall be solely responsible for the arrival condition of the Item at GAMENATION facilities. It is important that you carefully package the Item to ensure that the Item is delivered to GAMENATION without damage.
10. Consoles and Accessories or any hardware in general will not be accepted if the warranty seal is tampered or if they have been serviced earlier or if they have any physical damage on them. In some cases, we may offer an updated price value for the same, if accepted it’ll be tested and processed if it passes our testing procedure.
11. Game discs with medium to heavy level of scratches or burned edges will not be accepted even if they are in working condition to maintain the quality of the pre-owned games sold by us and the same will be returned back to you on payment of return shipping charges or will be shipped back for free along with a future buy order placed on our website. In case if the user chooses to get it back along with their buy order, the same has to be conveyed to us via email ([email protected]) after placing the buy order.
12. In the event of one or more of the products from an order failing our testing process and one or more of the products from the same order passing the testing process, you agree to provide us with the right to proceed with payment processing for the products that have passed the testing process. The products that have failed the testing process will be returned back to you based on your choice of immediate return which will be chargeable or free return along with future buy order (free return is applicable only for game discs and doesn’t apply for hardware).
13. If GAMENATION provides notification that your description of the Item was inconsistent with GAMENATION’s evaluation of your Item, you will be provided with an updated quote of cash or credit value in case if the product can still be accepted by us. You may elect to either sell your Item in exchange for the updated value, or you may elect for the Item to be returned to you upon your payment of return shipping charges and other charges incurred. In order to have the Item returned to you at your own expense, you must promptly respond to our email within 3 days of being contacted. If no response is received within this time period, we will presume that the updated cash value option is elected, and the Item will be processed using the updated value.
14. If the game is not received in its original box or in damaged condition, value would be deducted from the sell value towards charges incurred to replace the box. Deduction values as follows for standard single disc box: Rs.50 for PS4/PS5 games, Rs.150 for Xbox One/Xbox Series X games, Rs.200 for Nintendo Switch games. In case of any special type of box, deduction value will vary on a case to case basis and the same will be informed during the testing phase.
15. If the game is received without its original art cover, 30% of the game value subject to a maximum of Rs.500 would be deducted from the game value.
16. If the console is missing any included accessory, value for the same would be estimated and deducted from the sale value after informing the same. The console is expected to be sold to us along with all the accessories included in the package as sold by the manufacturer.
17. The time taken to complete the testing process for games will be 24 hours and 48 to 72 hours for consoles, accessories or any hardware in general from the time of shipment delivery to our office premises. Details of the testing results will be provided to you via email and also a detailed report will be available in My account once the testing procedure is complete.
GAMENATION WALLET : (STORE CREDIT)
1. A Gamenation wallet account is automatically created for you when you register on our website.
2. A Gamenation wallet account is also automatically created for all registered existing users of our website www.gamenation.in.
3. If you have chosen payment method as credit while placing your sell order, the value will be credited to your Gamenation wallet account once it passed our testing procedure.
4. The Gamenation wallet account can be used for future purchases on www.gamenation.in only. Any balance in the Gamenation wallet account is non transferable and cannot be withdrawn in the form of cash or bank transfer in any circumstance.
5. 1 Gamenation credit is worth Re.1 while purchasing any product from our website www.gamenation.in
6. Gamenation credits can be utilized to purchase any products from our website without any restrictions.
7. Gamenation credits come with unlimited validity and without any depreciation over time.
Extended Warranty Policy
1. It is established that the extended warranty package is an independent instrument and does not automatically get included with the purchase of any product or service, unless separately added to your cart during purchase.
2. Extended warranty is applicable to the primary item of purchase only, and does not include the auxiliary hardware or equipment that is included along with the purchase of the console. This is including but not all, gaming controllers, display cables, wires, consumables, additional plastic parts etc.
3. The scope of the extended warranty is applicable for any and all instances of internal hardware failure of your gaming console, barring a few exceptions related to voluntary tampering or negligence of care.
4. Any and all approved claims of the extended warranty will be addressed through repair services first. In the event of irrepairability of your hardware, a replacement of your hardware will be initiated. In cases where the item subjected to warranty is no longer available due to the rarity of it’s edition or limited in stock, a normal edition of the same hardware will be replaced instead that has the same specifications.
5. The extended warranty package offers free shipping benefits, where both the pick-up and drop services are included absolutely free of cost.
6. The time duration taken to fully process the extended warranty claim will vary depending upon the hardware’s requirements, which can only be assessed within 24 hours since the date of delivery at the headquarters. Gamenation guarantees that the warranty claim can be fully processed and completed within the committed time-frame conveyed upon the assessment of your hardware.
7. The coverage period of the extended warranty for pre-owned hardware automatically starts after the default 1 month warranty of your hardware lapses.
8. The coverage period of the extended warranty for new hardware automatically starts after the manufacturer’s warranty of your hardware lapses.
9. In an event where Gamenation processes a replacement for a new gaming hardware as per stated in clause 4, the replacement will be made with a pre-owned gaming hardware of the same specifications, where Gamenation reserves the right to choose the specific hardware that is offered as replacement.
10. The extended warranty package can be added to cart at the time of purchase of your hardware or 30 days since the date of purchase your hardware.
11. The extended warranty is deemed null and void if the seal is tampered with, removed, or broken.
12. The extended warranty is deemed null and void if any unofficial software is installed to the hardware or any malicious activity such as jailbreaking or piracy is being carried out using the hardware.
